Terms of Use & End User License Agreement (EULA)

These Terms of Use and End User License Agreement ("Terms") are a binding agreement between you and
Devesh Duptala, an individual based in New Zealand ("Yoink", "we",
"us"), governing your use of the Yoink mobile app and related services (the "App"). By
downloading or using the App, you agree to these Terms. If you do not agree, do not use the App.
1. The App
Yoink is a playful, social screen-time game. Squads share a "pool" of screen-time
minutes; you spend ("yoink") minutes to unlock blocked apps and earn minutes back through real-world
actions. It is a game for entertainment, not a medical, productivity, parental-control, or
device-management product, and is not a substitute for professional advice.
2. Eligibility
You must be at least 13 years old to use Yoink and capable of forming a binding
contract. If you are under the age of majority where you live, you confirm your parent or guardian
permits your use.
3. License
We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the App
on Apple devices you own or control, in accordance with these Terms and the Apple Media Services
Terms and Conditions / Apple's Licensed Application End User License Agreement ("Apple Standard
EULA"), which apply in addition to these Terms. Where these Terms conflict with the Apple Standard EULA,
the Apple Standard EULA governs the license of the App.
4. Your account
You sign in with your phone number via a one-time passcode. You are responsible for your account and
your device. Don't impersonate others or use someone else's number without permission.
5. Acceptable use
You agree not to:
- break the law, or use Yoink to harass, bully, or harm others;
- cheat, exploit, automate, reverse-engineer, or tamper with the game, economy, or our systems;
- create multiple accounts to abuse trials or rewards;
- disrupt or attempt to gain unauthorized access to the App or other users' data.
We may suspend or terminate accounts that break these rules.
6. Strict Mode (device app-deletion lock)
Squads can run Strict Mode, a fixed-length commitment of 3, 7, or 14 days. You need
to understand what you are agreeing to before you join one:
- A squad host can only propose a round and its length. Proposing it does not
restrict anyone's phone by itself.
- Each member, including the host, has to opt in separately on their own device. When you opt in,
you are shown the end date and told what will happen.
- While you are locked in, Yoink turns on Apple's device-wide app-deletion
restriction. This is not limited to the apps you chose to block: for the
length of the round you will not be able to delete apps from that device, including Yoink itself.
- There is deliberately no early individual off switch, because a shared commitment
that anyone can quietly drop is not a commitment. The lock ends when the round's end date arrives, or
if the host ends the round early for everyone.
- You can always get out by leaving the squad or deleting your account, either of
which clears the restriction immediately and does not need the host's permission. Leaving costs you
your squad membership, not your control of your own device.
We record, on our servers, which members opted in and until when, so that a round's state is
auditable and so your device can release the restriction as soon as the round is genuinely over. Do not
opt in to Strict Mode on a device you may need to remove apps from during the round.
7. In-game items have no real-world value
Screen-time "minutes", coins, streaks, the "pool", and similar items are virtual, in-game
items for entertainment only. They have no monetary value, cannot be redeemed
for cash, and are not your property. We may adjust, reset, or remove in-game items and balances as part
of running the game.
8. Subscriptions (auto-renewable in-app purchases)
Yoink offers one optional auto-renewable subscription, the Squad Pass, which unlocks
premium features for a whole squad. One member subscribes, and the squad that member is currently in is
unlocked for everyone in it. The Squad Pass is offered in two billing periods: Weekly
and Annual.
Subscription terms:
- Free access trial: new users may receive 3 days of free premium
access, one per person. This is granted by Yoink's server and is separate from an App Store
introductory offer. Starting a paid subscription follows the price and billing confirmation Apple
shows at purchase; free access does not postpone or alter Apple's billing schedule.
- What it unlocks: the paid entitlement belongs to the subscribing member. Their
current squad receives Squad Pass benefits while that member belongs to it; other members are not
charged.
- If you leave a squad: its shared benefit ends unless another member supplies an
active Pass. Your paid entitlement remains yours and can benefit a later squad after reconciliation
or Restore Purchases. Leaving does not cancel or refund the Apple subscription.
- Cancelling is not the same as a refund. Turning off auto-renew stops future
charges; your premium continues until the end of the period you already paid for, then ends. A refund
(money back) is a separate request handled by Apple, and takes effect as soon as Apple approves it.
- Price is shown in the App at purchase and may vary by region; Apple displays the
exact localized price and period before you confirm.
- Auto-renewal: the subscription automatically renews for the same period unless you
turn off auto-renew at least 24 hours before the end of the current period. Your
Apple ID is charged within 24 hours before the period ends.
- Manage or cancel any time in iOS Settings → [your name] → Subscriptions.
Deleting the App or your Yoink account does not cancel a subscription, you must cancel
it with Apple.
- Payment is charged to the subscribing member's Apple ID and managed through
Apple; RevenueCat helps Yoink reconcile purchase and entitlement status.
- Refunds are handled by Apple under the Apple Media Services Terms; we cannot
directly issue refunds for App Store purchases. If Apple approves a refund, premium for that squad ends.
9. Coins, Rewards & Prize Draws
Yoink has an optional in-game economy on top of the base game:
- Coins are earned, never bought. Squads earn coins through in-game activity
(earning minutes, squad step goals, Explore check-ins). There is no way to purchase coins
with real money, at any price, from us or anyone else. Coins have no cash
value, are not transferable, and cannot be redeemed for cash or exchanged outside the
App.
- Redemption. A squad may spend its earned coin balance in the in-app
Rewards marketplace, whose available catalogue may include pool-minute boosts or
promotional premium grants. Some rewards are limited to one redemption per squad
(stated on the reward). Some rewards may require an active Squad Pass to redeem. Rewards are
subject to availability and stock, and we may change or retire the marketplace catalogue at any
time.
- Prize promotions are not currently offered. If Yoink later offers a raffle,
sweepstakes, or prize draw, we will publish promotion-specific official rules, covering eligibility,
dates, odds, how winners are picked and any regional restrictions, before entries open.
No purchase will be necessary, entries will be void where prohibited, and Apple will not sponsor it.
- Eligibility. You must be a squad member in good standing and meet the general
eligibility in Section 2 (13+, or the age of majority where you live, for prize receipt).
Employees, contractors, and immediate family of Yoink are not eligible to win. We may disqualify
entries obtained through cheating, exploits, or multiple accounts (see Section 5).
- Apple is not a sponsor. Apple Inc. is not a sponsor of, and has no
involvement in, any Yoink raffle, sweepstakes, or prize draw.
10. Changes to the App and features
We are actively developing Yoink. We may add, change, or remove features (including premium
features), or change pricing for future purchases, and may discontinue the App. We'll act reasonably and
comply with Apple's rules for any subscription changes.
11. Disclaimers
The App is provided "as is" and "as available" without warranties of any kind, to
the fullest extent permitted by law. We do not warrant the App will be uninterrupted, error-free, or
that earnings, shields, notifications, or screen-time controls will always work as intended. Nothing in
these Terms limits rights you have under the New Zealand Consumer Guarantees Act 1993 or
other mandatory consumer law that cannot be excluded.
12. Limitation of liability
To the maximum extent permitted by law, Yoink (Devesh Duptala) is not liable for any indirect,
incidental, special, or consequential damages, or loss of data, arising from your use of the App. Where
liability cannot be excluded, it is limited to the amount you paid us (if any) in the 12 months before
the claim, or NZ$50, whichever is greater.
13. Termination
You may stop using the App and delete your account at any time (Profile → Settings (gear icon) → Danger zone →
Delete account). We may suspend or terminate your access if you breach these Terms or to
protect the service or other users. Sections that by their nature should survive (e.g. 6, 8, 10, 11, 13)
survive termination.
14. Governing law
These Terms are governed by the laws of New Zealand, and you submit to the
non-exclusive jurisdiction of the New Zealand courts, without affecting any mandatory consumer-law rights
in your country of residence.
15. Apple-specific terms
You acknowledge that:
- These Terms are between you and Yoink (Devesh Duptala) only, not with
Apple. Apple is not responsible for the App or its content.
- Apple has no obligation to provide maintenance or support for the App.
- If the App fails to conform to any applicable warranty, you may notify Apple and Apple may refund
the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty
obligation for the App.
- Apple is not responsible for addressing any claims relating to the App (including
product liability, legal/regulatory non-compliance, or consumer protection).
- Apple is not responsible for investigating or resolving third-party
intellectual-property claims about the App.
- You represent you are not located in a country subject to a U.S. Government
embargo or designated "terrorist-supporting", and are not on any U.S. Government restricted-parties
list.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may
enforce them against you.
